Terms of Service

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use Creamind. By using the platform, you represent that you meet these requirements and that the information you provide is accurate. The platform is intended for creators (influencers, content creators) and brands (businesses, organizations) seeking to collaborate on gigs and campaigns.

2. Account Registration and Security

You may need to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.

3. Use of the Platform

You agree to use Creamind only for lawful purposes. You must not:

• Violate any applicable law or regulation.
• Impersonate any person or entity or misrepresent your affiliation.
• Post false, misleading, or fraudulent content (e.g. fake metrics, fake gigs).
• Harass, abuse, or harm other users or Creamind staff.
• Scrape, copy, or use automated means to access the platform without permission.
• Interfere with or disrupt the platform, servers, or networks.
• Use the platform for any purpose that competes with or undermines Creamind.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or applicable law.

4. Gigs, Bids, and Agreements

Creamind facilitates the discovery and connection between creators and brands. Gigs posted by brands and bids or proposals submitted by creators are agreements between those parties. Creamind is not a party to those agreements unless otherwise stated. We do not guarantee the quality, legality, or completion of any gig or collaboration. Payment terms, deliverables, and deadlines are between the brand and the creator; we encourage clear written agreements outside the platform where appropriate.

5. Content and Intellectual Property

You retain ownership of content you submit (e.g. profile information, proposals, creative work). By submitting content, you grant Creamind a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as needed to operate the platform. You represent that you have the right to grant this license and that your content does not infringe any third party's rights. We may remove content that we believe violates these Terms or our policies.

6. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREAMIND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTIONS BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM PERMITTED BY LAW.

8. Indemnification

You agree to indemnify, defend, and hold harmless Creamind and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the platform, your content, your violation of these Terms, or your violation of any third party's rights.

9. Termination

You may close your account at any time through account settings or by contacting us. We may suspend or terminate your account or access to the platform at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the platform ceases. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive termination.

10. Disputes and Governing Law

These Terms are governed by the laws of the jurisdiction in which Creamind operates, without regard to conflict of law principles. Any dispute arising from these Terms or the platform shall be resolved in the courts of that jurisdiction. Disputes between users (e.g. creators and brands) are between those users; we are not obligated to resolve them but may facilitate communication where appropriate.

11. Changes to the Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Your continued use of the platform after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the platform. For material changes, we may notify you by email or a prominent notice on the platform.
